Terms and Conditions of Supply of LASERGAMING AND HIGH ROPES LTD.

Terms and Conditions for LASERGAMING AND HIGH ROPES LTD, hereafter known as ‘The Company’, Lasergaming, Lasergaming Oxford, High Ropes Oxford, Oxford Adventure park and ‘the venue’ together with all The Company’s associated companies and brands.

General

  1. These Booking Terms and Conditions contain important information concerning participation by you and members of your party and, accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Booking Terms and Conditions.
  2. No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by The Company.
  3. Any typographical clerical or other error or omission in any booking confirmation or other documentation issued by The Company (including any electronic documentation) shall be subject to correction without any liability on the part of The Company.
  4. The Company reserves the right to make changes to the Activities whether to conform with any applicable safety, other statutory requirements or otherwise.

 

1. Introduction
outdoorlaser.com (“site”) is owned and operated by LASERGAMING AND HIGH ROPES LTD, a company registered in England and wales under company number 14014736 and with our registered office at Unit 128, Culham No1 Site, Culham Oxfordshire, OX14 3DA, site address at Furze Brake Woodland, Rear of Culham No1 Site, Oxfordshire, OX14 3DA

Please read these terms and conditions carefully before placing an order. By purchasing services on this Site, you agree to be bound by these terms and conditions. If you are not willing to be bound by these terms and conditions, please do not purchase services from this Site.  Please also note we do not refund sessions that cannot go ahead due to covid or any other variant or late cancellations of the session under any circumstances. 

Please note – In the event that any players, guests, or family members of booked participants contract COVID-19, flu or any other variant, we regret to inform you that we will not be able to accommodate session changes, transfer of places or provide refunds. All individuals are expected to adhere to the guidance and regulations set forth by the National Health Service (NHS) and the UK government as applicable at the time of the session. Please note that this term applies only when there are no COVID-19 or other variant restrictions in effect in the UK.  If you would like to contact us about your booking if you have covid, please email us at lasergaming@oxfordadventurepark.com

2. Changes to terms
We reserve the right, at our discretion, to modify, add, or remove any or all of these terms and conditions at any time and each such change shall be effective immediately upon posting.
Please check these terms and conditions periodically for changes.  Your continued use of this Site and purchase of services on this Site following the posting of changes to these terms and conditions will mean you accept those changes. Please check the terms before every purchase.

 

3. Privacy policy and Acceptable use policy
Registration and other information provided by you is subject to our Privacy Policy and shall only be used in accordance with it. For more information, please go to our Privacy Policy

 

4. Age restriction
You shall not purchase any services from our Site if you are below the age of 18 years old because under this age, you do not have legal capacity to enter into a contract.

 

5. Acceptance of booking/Booking Confirmation
5.1. These Terms will become binding on you and us and a Contract will come into effect between you and us only upon our written acceptance of the order issued to you by email (Email Confirmation) We are not bound by the order unless we accept it in writing.

5.2. If there is any conflict between these Terms and any term of the order, the order will take priority.

5.3. No booking shall be deemed to have been accepted unless accepted in writing by The Company (which shall include Lasergaming’s email confirmation of booking).

5.4. These Booking Terms and Conditions incorporate LASERGAMING AND HIGH ROPES LTD Privacy Policy, and Online Waivers and Risk Acknowledgement and Disclaimer. Each player of your party will be required to sign the online Waivers and Risk Acknowledgement and Disclaimer before being allowed to undertake the Activities.

5.5. You must advise LASERGAMING AND HIGH ROPES LTD as soon as possible of any mistake in LASERGAMING AND HIGH ROPES LTD booking confirmation. LASERGAMING AND HIGH ROPES LTD shall use its reasonable endeavours to ensure that you and your party’s participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the Activities and no refunds or compensation will be payable in such circumstances.

 

6. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and us and supersedes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.

 

7. Representations
7.1. You acknowledge and agree that by entering into this Contract with us you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms or the Privacy Policy.

7.2. You shall not have any claim for innocent or negligent misrepresentation against us based on any statement in this Contract.

7.3. Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the services. Any representation, condition or warranty which might be implied or incorporated into these Terms by statute, common law or otherwise is excluded to the fullest extent permitted by law.

 

8. Provision of Services
We will supply the services to you from the date set out in the order for the period set out in the order.  We will make every effort to provide the services on time. However, there may be delays due to an Event Outside Our Control, see Clause 13 – Circumstances Beyond Our control.

 

9. Your Right to cancel the activities/services for your booking – for any size booking under 30 people.

9.1. Before we begin to provide the activity that you have booked for, you have the following rights to cancel our services:

9.2. Subject to clause 9.5 below, you may cancel any order for our services/activities prior to 30 days before your activity date detailed on your email confirmation of your booking, by emailing us at lasergaming@oxfordadventurepark.com. We will confirm your cancellation in writing to you;  Please contact us if you have not received this within 48hrs of your cancellation email.

9.3.Prior to 30 days before your activity date you can cancel an existing booking and receive a full refund, minus the card transaction fees/other refund fees from stripe. You can also amend your booking free of charge.  All refunds are made via BACS.

9.4. If you cancel an Order under clause 9.2 and 9.3 and you have made any payment in advance for services that have not been provided to you, we will refund these amounts to you minus the card transaction fees/other refund fees from stripe.  All refunds are made via BACS.

9.5. If we have completed providing the activities/services, you have no right to cancel, even if this is up to 30 days prior of our email confirmation of your order.

9.6. Should LASERGAMING AND HIGH ROPES LTD, for reasons beyond their control in accordance with clause 13 (including high winds, lightning storms and icy conditions, Flash flooding, snow), feel it is necessary to close the activity once your party have already commenced participation, you will be offered alternative times or dates to return within one year and rescheduled free of charge. In such circumstances, you will not be entitled to a refund, in part or whole.

9.7. Payments made by debit or credit card, BACS or any other method will be refunded back by BACS. Payments only.  Gift Vouchers will be refunded by the issuing of a replacement Gift Voucher to the same value.

9.8. Should you need to cancel your booking due to local, regional or National lockdowns, restrictions or legislation for any pandemics imposed by the government, we will be happy to, free of charge, reschedule for a future date, or arrange a gift voucher for the full value of your booking, redeemable within 12 months. We will be unable to offer a refund.  

9.9. Transferring your session to an alternative date.  We appreciate there are times where you will need to transfer your booking to a different date. You may transfer any order for our services/activities prior to 30 days before your activity date detailed on your email confirmation of your booking, by emailing us at lasergaming@oxfordadventurepark.com. We will confirm your new date/time in writing to you;  Please contact us if you have not received this within 48hrs of your cancellation email.

9.10. Decreasing numbers.  In accordance with this clause, you may reduce your numbers for any order for our services/activities prior to 30 days before your activity date detailed on your email confirmation of your booking, by emailing us at lasergaming@oxfordadventurepark.com. We will confirm your reduction in numbers for you, in writing to you;  Please contact us if you have not received this within 48hrs of your cancellation email.  If any refund is due from the reduction in numbers up to 30 days prior to your activity date, this will be minus the transaction fees and refund fees as detailed in clause 19.

9.11 We do not offer refunds under any circumstances for any no-shows, cancellations due to COVID, other serious illnesses, or any circumstances whereby any member of the group is required to self-isolate.  

9.12 No-shows, late arrivals, decreased numbers, and non-attendance.  Please note we do not refund sessions, transfer sessions or offer vouchers for no-shows, late arrivals, decreased numbers or non-attendance under any circumstances.  If you wish to decrease numbers, it will need to be in accordance with clause 9.10 above.

9.13 In the event that any players, guests, or family members of booked participants contract COVID-19, flu or any other variant, we regret to inform you that we will not be able to accommodate session changes, transfer of places or provide refunds.

 

10. Your Right to cancel the activities/services for your booking – for large group sizes of 30 people + more and 60 players+ more

10.1. Before we begin to provide the activity that you have booked for, you have the following rights to cancel our services:

10.2a. Subject to clause 10.5 below, if your group size is between 30-60 players, you may cancel any order for our services/activities Prior to 60 days before your activity date detailed on your email confirmation of your booking, by emailing us at lasergaming@oxfordadventurepark.com. We will confirm your cancellation in writing to you;  Please contact us if you have not received this within 48hrs of your cancellation email.

10.2b. Subject to clause 10.5 below, if your group size is 60 players or more, you may cancel any order for our services/activities Prior to 90 days before your activity date detailed on your email confirmation of your booking, by emailing us at lasergaming@oxfordadventurepark.com. We will confirm your cancellation in writing to you;  Please contact us if you have not received this within 48hrs of your cancellation email.

10.3a.For group sizes between 30-60, Prior to 60 days before your activity date you can cancel an existing booking and receive a full refund, minus the card transaction fees/other refund fees from stripe. You can also amend your booking free of charge.  All refunds are made via BACS.

10.3b.For group sizes of 60 or more, Prior to 90 days before your activity date you can cancel an existing booking and receive a full refund, minus the card transaction fees/other refund fees from stripe. You can also amend your booking free of charge. All refunds are made via BACS.

10.4. If you cancel an Order under clause 10.2 and 10.3 and you have made any payment in advance for services that have not been provided to you, we will refund these amounts to you minus the card transaction fees/other refund fees from stripe. All refunds are made via BACS.

10.5. If we have completed providing the activities/services, you have no right to cancel, even if this is up to 60 days (group sizes 30-60) or 90 days (group sizes 60+) prior to our email confirmation of your order.

10.6. 11.Price and payment

11.1. Prices of the services are specified on our Site and confirmed on the checkout page or on the invoice if you are a school or your organisation. We may change our prices at any time, but that will not affect the prices for confirmed orders already paid for.

11.2. Payment for services is to due in full and to be made in advance by credit or debit card except where agreed otherwise in writing between us. We accept payment of all major credit and debit cards.

 

12. Limitation of liability 

12.1. Except as otherwise provided in these Booking Terms and Conditions LASERGAMING AND HIGH ROPES LTD shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of, or participation in, the Activities or services we provide.

12..2. Parking facilities are available at the site, and any vehicles are left at the owners’ risk

12.3  Except as otherwise provided in these Booking Terms and Conditions any liability of LASERGAMING AND HIGH ROPES LTD shall be limited to the refund of any charges paid to LASERGAMING AND HIGH ROPES LTD

12.4. Nothing contained in these Booking Terms and Conditions is intended to, nor shall, limit the liability of LASERGAMING AND HIGH ROPES LTD in respect of death or personal injury caused by the negligence of LASERGAMING AND HIGH ROPES LTD or of its employees, agents or contractors.

 

13. Circumstances beyond our control

13.1. If there is failure to perform, or delay in performance of any of our obligations under these Terms due to Circumstances Beyond Our Control, we will not be liable for such failure.

13.2. Circumstances Beyond Our Control include but are not limited to, any Force Majeure, outbreak, act or event beyond our reasonable control, including without limitation lock-outs, strikes, or other industrial action by third parties, riots, civil commotion, terrorist attack or threat of terrorist attack, invasion, war (whether declared or not) or threat or preparation for war, explosion, fire, flood, storm, thunder and lightning storms, extreme heat, subsidence, epidemic, Pandemic, earthquake, or other natural disaster, or failure of private or public telecommunications networks.  This also includes any lockdowns regionally, locally and nationally or any restrictions imposed by the government, district councils or local guidance and any incidents locally.  This also includes requirements to self isolate. This also includes any variant of/and Covid.

13.3. Circumstances Beyond Our Control also includes any major traffic incidents that occur on the way to our event that affect your arrival time.

13.4. Circumstances Beyond Our Control also includes low numbers, extreme weather, cold and hot, thunder and lightning, snow or other natural damages to our site, vandalism of our site, unexpected group and session cancellations, or other events which may create unacceptable risk to health and safety or the inability to run an acceptable standard of session.  in these circumstances, we reserve the right to cancel your booking and offer an alternative date.  Please note in these circumstances, we do not offer any refunds in any circumstances.  We will transfer the session to another time or give you a credit note to re-book at another time.

13.5 Circumstances Beyond Our Control also include chasing forms that have to be re-filled and redone by parents or players due to their errors and contacting players and parents to make sure these are done correctly.

 

14. Miscellaneous

14.1. We may assign our rights and obligations under these Terms to any another person. If there is any such assignment of rights and obligation, we will inform you in writing or by email.

14.2. You cannot transfer your rights and obligations under these Terms to any another person without our written approval.

14.3. This contract is only between you and us. No other third person shall have any rights to enforce any terms.

14.4. Each paragraph of these Terms are separate and distinct form other. If any court or relevant authority determines any clauses of these Terms is unlawful, then such determination will not affect other clauses and all other remaining clauses will remain in effect and full force.

14.5. English law governs these Terms and contract between you and us. English courts will have jurisdiction on any dispute that may arise out of this Terms or contract between you and us.

16. Making a booking with us

16.1. Bookings can be made securely online through our website at outdoorlaser.com

16.3. To book a session for a specific time on a specific date we require payment in full, in advance of the session.   This payment prevents others from booking this session on a specific time on a specific date and is therefore non-refundable at the point the amount is paid and the booking is confirmed in accordance with clauses 9 and 10 above.

In the event that the number you have booked for decreases the full amount for the players booked is still due in full.   You do not have a valid booking unless you have received your booking confirmation via e-mail.  Should you have not received this within 48hrs of booking, please contact us through our contacts page on our website.  Please see clauses 9 and 10 above.

16.4. Payment for services is to due in full and to be made in advance by credit or debit card except where agreed otherwise in writing between us. We accept payment of all major credit and debit cards.   We do not accept cheques.  We do not accept deposits.

16.5. You and each member of your party or group will be required to sign the online waivers form to acknowledge the risks involved with our activities, before undertaking any of our activities.  All participants under the age of 18 require their parents to sign on their behalf in order for them to take part.  Please note this is a booking condition, that all participants must have this form completed and signed online prior to the session commencing, in order for them to participate on the day.
In the event a child or adult does not have their online waiver form signed beforehand they will be denied entrance to the activity and will not be able to take part.  In the event, a player over 18 or a parent has filled out a form incorrectly, and this has to be re-done and re-submitted, in the event we cannot get hold of a contact/emergency contact, they will be denied entrance to the activity and will not be able to take part.  The monies will still be due for this player, no refunds will be given.

16.6. Once payments are received for our sessions they are non-refundable in accordance to clauses 9 or 10 above.. In the event that members of the group are a ‘no-show’ on the date booked the session price and price per player for those players will still be due and are non-refundable.

16.7. When you make a booking with us, you confirm that you have read these terms and conditions carefully before placing your booking. By purchasing and making this booking on our Site, you agree to be bound by these terms and conditions.  You are also asked to confirm you understand and agree that if your booking has to be cancelled due to covid,  you will be given a credit note to re-book at another time.

 

17. Number of participants

17.1. Depending on what type of session you have booked with us, you would have booked for a specific number of participants, for a specific time and date and paid to reflect this.  Please keep to the numbers that you have already booked.  We cannot accommodate extra players on the day.  In the event you turn up with extra players or over-invite without booking places first, players will be turned away so please help us to avoid this.

17.2. If you do wish to increase your numbers please email us first so we can check we have availability as it may not always be possible.  In the event you attend with more participants than you have booked for, please note, any participants over the number booked will be turned away and will be unable to take part.

17.3. In accordance with clauses 9 and 10, we can only reduce the numbers of your booking prior to 30/60 days of the booking date as detailed on your email confirmation.  Even if you have less people attend on the day, the full amount will still be due and no refunds will be made for non attendees, sick players, on the day illness, later arrivals, unforeseen circumstances or no shows.

 

18. Age and Height Restrictions

18.1.  The minimum age for Lasergaming, Tree climbing, Orienteering, Crate Stacking, Team challenges and any other activities or adventure days is 8 years old for all our sessions, with exception of our Exclusive Use Option where the minimum age is 7 Years.  You are advised of this age restriction on our website.

18.2. Please ensure that you comply with the minimum age  and height restrictions, as players attending who do not meet the minimum requirement will be turned away from the site and no refunds will be made.

18.3. For birthday parties, we take children celebrating their 9th Birthdays onwards.  The only 8th Birthday parties we can provide have to be booked for exclusive use where the minimum age for guests is 7 years and must be a minimum height of 122cm.  This type of party is exclusive and is based on a minimum charge of 25 players.  Players need to be physically capable of holding a range of laser guns unaided in the outdoor woodland environment.

18.4. Our parties are arranged in age groups that compliment each other.  9th, 10th and 11th Birthdays and 11th, 12th, 13th, 14th Birthdays.  Please ensure you book the correct sessions based on the players ages.

18.5.   These age ranges are; birthday parties for 9th, 10th, 11th birthdays can have players aged 8 years – 11 years in.  Birthday parties for 12th, 13th, 14th and 15th Birthdays can have players aged 11 years to 15 years in.  As outlined on our booking system, all parties are only allowed up to 2 players included in the numbers already booked and paid for to be outside of those age ranges, this can be used for siblings and adults you wish to include

 

 

19. Cancellation charges

In accordance with clauses 9 and 10, in the event your session is refunded or a refund is requested in line with clause 9 or 10, you will be refunded minus the booking fees which are card transaction fees/other refund fees from stripe which are charged by stripe to complete the transaction.  These amounts can be found on stripes website and apply to all businesses.

For any payments and refunds made by bank transfer, this will include any bank charges involved in the receiving and the refunding of the payment/monies.

Refunds will be made by BACS only, please provide your bank details along with any refund request within these terms.

 

20. When we have to cancel

20.1. Under circumstances out of our control as in accordance with Clause 13 above, including but not limited to; force majeure, Outbreaks of a pandemic, epidemics, low numbers, extreme weather, cold and hot, thunder and lightning, snow or other natural damages to our site, unexpected group and session cancellations, or other events which may create an unacceptable risk to health and safety or the inability to run an acceptable standard of the session, we reserve the right to cancel your booking and offer an alternative date.  No refunds will be made.

20.2. Under such circumstances we transfer sessions to an alternative date, no refunds will be made.  We do not accept liability for any additional or associated costs that may be incurred as a result of the cancellation or necessary change. Our activities are all-weather sports and activities and will normally proceed regardless of weather conditions. In adverse weather conditions, you should assume your booking will proceed unless directly advised by us otherwise.

20.3. Minimum number of players For Adventure days, Adventure Camps and Pay and Play sessions only.
For Adventure days and pay and play sessions where we allow players to book in as individuals or small groups, there is a minimum number of players required to run a session and that number is 10 players in total.  We are an experienced based service so if we do not have enough players to run the games, this will have a detrimental impact on our customers experience.  In the event we have less than 10 players booked in for the session, we will have to cancel the session.  You will have 2 options, to reschedule the session at another time or you will be offered a refund of the monies paid.  In the event this happens We do not accept liability for any additional or associated costs that may be incurred as a result of the cancellation or necessary change.  Where possible, 48hrs notice will be given for cancellations.

 

21. Outbreaks of a Pandemic, COVID, Epidemic or other likely variant.

21.1. Under such circumstances where there is an outbreak of a pandemic such as COVID-19 / Coronavirus or any other variants, we will follow all regional, national and local guidelines with regards to operating.  The Health and Safety of all our clients and visitors are of primary importance and will always come first.   These types of worldwide Pandemics are fast changing, in the event we do still operate, all possible precautions will be taken on site and safety measures may change on a daily basis.

In the event we have to Cancel any sessions or the Government decides to impose sanctions/restrictions to limit the attendance of events/gatherings then all bookings will be rescheduled to an alternative time that suits you, in the future.  Please note we would be unable to offer refunds for sessions.  The session can be any time in the future, your credit for the session will be valid for 2 years.  As we are a small business, in the event this happens, We do not accept liability for any additional or associated costs that may be incurred as a result of the cancellation or necessary change caused from this.

21.2 In the event that any players, guests, or family members of booked participants contract COVID-19 or any other variant, we regret to inform you that we will not be able to accommodate session changes, transfer of places or provide refunds. All individuals are expected to adhere to the guidance and regulations set forth by the National Health Service (NHS) and the UK government as applicable at the time of the session. Please note that this term applies only when there are no COVID-19 or other variant restrictions in effect in the UK.

 

22. Temporary Measures in place due to the Pandemic.

We have put a number of temporary measures in place in accordance with legislation, our insurers and local guidance from the district councils for our sessions for the foreseeable future.  These are detailed on our website and are subject to change without notice.  These include but are not limited to, limits on numbers of players, online waivers, covid release waivers, These recommendations are made by our insurers and the local district council.  We will let you know what is required once your booking is made.

 

23. Arriving Late

23.1. We can not accommodate late arrivals, The company requires participants to be ready to take part in the activity 10-15 minutes prior to a designated ‘start-time’ to enable check in to take place.   The time stated on your confirmation is the ‘start time’. We recommend on our invitations and in the confirmation of bookings that all participants arrive 10-15 minutes before the session starts. This is communicated to you several times before the session date.

23.2. Unfortunately due to the temporary measures put in place and due to our health and safety policy, customers will NOT be allowed to participate if they are not on time.  As soon as our staff departs the car park and all necessary checks have been completed, we are unable to allow any last-minute arrivals to join the session. In accordance with clause 9 and 10, no refunds will be given for late arrivals.

23.3 We can not accommodate late guests under any circumstances.

 

24. Exclusion from the venue.

24.1. The venue has the right, at all times, to refuse participants access to the booked activity at any stage of the booking and remove them from their venue if in their opinion the participants are under the permitted age; are unfit to take part in the activity because of physical or mental impairment; be under the influence of alcohol or drugs; have arrived too late to take part in the pre-activity safety checks and briefing; consider them to be a danger to themselves, other participants or members of staff; or are displaying aggressive, discriminatory and abusive behavior (verbal or physical). If any of these occurrences apply, the booking will have been deemed to have been cancelled and no refunds will be given.

24.2. Should any participant damage the property of the venue of verbally or physically injure a member of the staff or other participants, they will be dealt with by the venue management accordingly and may face prosecution by the venue. The Company will not become involved in such matters other than to supply the necessary authorities with contact details of the offending party/parties. Any communications relating to such matters should be conducted between the venue, the offending party / parties and the authorities.

24.3. We have a zero-tolerance policy when it comes to customers and guests who display unreasonable, discriminatory, abusive, and threatening behaviour on the telephone, via emails or in-person on our site. No member of staff should be subjected to violent, discriminatory and abusive behaviour and it is not conducive to running a positive event, especially where children may be present.  This includes shouting, swearing, becoming aggressive, or using threatening body language or gestures.

24.4. On the phone or via email.  We reserve the right to close a meeting, cease replying via email or end a telephone call in the event any individual is displaying unacceptable behaviour to eliminate the risk of the incident escalating.  The incident will then be reported internally and then will be reviewed and if necessary investigated. If we feel that it is in the best interests of the company to cancel your session and refund you so you can make alternative arrangements then we will confirm this in writing to you.

24.5. In person – We reserve the right to ask you to leave the site in the event any individual is displaying unacceptable behaviour included but not limited to clause 24.3. to eliminate the risk of the incident escalating.  The incident will then be reported internally and then will be reviewed, investigated and if necessary reported to the police. If we feel that it is in the best interests of the company to cancel your session and refund you so you can make alternative arrangements then we will action this with immediate affect and confirm this in writing to you.

For the avoidance of doubt, discriminatory means making or showing an unfair or prejudicial distinction between different categories of people or things, especially on the grounds of race, age, gender or sex.

 

 

25. Personal Safety

25.1. Players take part at their own risk.  Whilst all our activities are as safe as they can be, safety instructions must be followed at all times as well as any instructions from the instructors or marshals on the day. You are advised not to attempt to go beyond your capabilities or engage in risky or daring behaviour. All physical activities by definition involve an element of risk so it is a given that you undertake the activity with the full understanding of this and accept responsibility for your own safety and the risks involved in taking part.

25.2. In the case of more than one person taking part under one booking, it is a given that the person booking the group with us has relayed the details of the activities to the group and the parents of the group and that the individuals in the group have acknowledged the possible risks involved and that they have agreed to take part on this basis.  In the case of under 18’s participating, the person booking with us has explained to all parents the risks involved.  We carry our own public liability insurance.

25.3. For tree climbing, ropes and crate stacking activities participants will be required to wear a safety harness and safety helmet.  An instructor will fit these.  In some cases, our instructor may also fit an additional chest harness

 

26. Late Start

26.1. Due to the nature of our activities, unforeseen circumstances can delay the start of an event. In all cases, the venue will endeavor to minimise your inconvenience and will start the session as soon as possible.  The action taken will be dependant on the circumstances surrounding the situation. As such incidences cannot be predicted your understanding is appreciated.

26.2. Should you choose not to accept the later start time and do not take part in the activity on the same date, no other recompense will be offered from The Company. All communications as a result of such circumstances should be with the venue directly as it will be deemed that The Company has fulfilled their booking with you.

26.3. All bookings will be subject to these same conditions without exception. All customers will have deemed to have made themselves aware of these Terms & Conditions and will have accepted them as part of their booking with The Company. No verbal or other communication overrides these terms and conditions in any respect whatsoever.

 

 

27. Weather

27.1. Bad weather, Rain and patchy showers are acceptable conditions that do not require cancellation.  We are an all-weather provider and continue in Rain, sleet and light dustings of Snow.  As per clause 13, in the event thunder and lightning occurs during the session, the session will be stopped, all participants will be taken to the forest shelter until the bad weather dispersers.  After it has passed, the session will then continue as normal.  In the event there is thunder and lightning that is continuous, does not stop or is not safe for us to continue with the session, we reserve the right to cancel the session and reschedule the session to another time.  Safety always comes first!  Please notes as per clause 13, no refunds will be made but we will transfer the session to an alternative date for you.

27.2. In the event that weather is so severe that the session has to be cancelled by us, (extreme heat, extreme cold, severe gales, thunder and lightning, medium – heavy snow) we will notify you at our earliest convenience and re-schedule your session for another time.  No refunds will be given.  If our venue is operating in adverse weather conditions as normal, and can provide a safe well managed session, in the event you choose to cancel your session, you will do so in accordance with our cancellation policy.

27.3. For tree climbing, ropes and crate stacking only, these activities will remain open in most weather conditions, but may be cancelled in weather conditions such as Gales, heavy ice and snow.

27.4. Our activities can be enjoyed in a variety of weathers, providing participants are suitably clothed, in rain we highly recommend waterproof clothing and hot weather cool layered clothing, Long t-shirts and Long Trousers and if possible sunscreen and insect repellent.  Suitable footwear such as trainers or walking boots only is a must as the woodland has many uneven terrains and muddy areas.

 

 

28. Online Waivers, Risk Acknowledgement and Disclaimer forms

28.1. You and each member of your party or group will be required to sign online waivers to acknowledge the risks involved with our activities and to confirm they are not suffering from any medical condition or injury whereby taking part would worsen their injury/condition or put others at risk, before undertaking any of our activities.  We ask you to complete these online waivers no later than 24hrs before the session.

28.2. All participants under the age of 18 require their parents or a legal guardian to sign on their behalf in order for them to take part.  Please note this is a booking condition, that all participants must have this form signed and completed online prior the session, in order for them to participate on the day.  In the event a child or adult does not have their form signed and completed and this has not been done prior to the commencement of the session, they will be denied entrance to the activity and will not be able to take part.  In the event, a form has been submitted but it has errors on, lack of information or any medical/other conditions have been ticked but no information has been supplied then we will contact the parent/player/emergency contact and ask for this to be re-submitted.  If we cannot reach anyone, the player will be unable to take part.   The monies will still be due for this player.

28.3. Forms can be completed and submitted online using the link given after you have booked.

28.4. In the event there is a medical condition listed where we believe this will make it more likely you will either be injured or cause an injury to another or whereby we may not be able to manage the session safely, we will refer this to your medical team who are medically qualified to make that decision on your behalf in terms of taking part safely and any changes we need to make.

28.5. Due to the physical nature of the Activities, LASERGAMING AND HIGH ROPES LTD recommends that pregnant women should not take part. Pregnant women who still wish to undertake the activities will be required to sign an online waiver disclaimer confirming that they are aware that there are risks to them and to their unborn child and that participation in the Activities is at their own risk

28.6. Any players with Asthma MUST have their inhaler with them on the day to play.

 

29. Asthma and other medications

It is a term and condition that anyone taking part in any of our activities must have the correct medications, that belong to them, on them at all times to be able to self administer for ALL medical conditions they have.  This applies to adults and children.  In particular Asthmatics, regardless of how long ago their last attack was or if it is occasional asthma, seasonal asthma they MUST have their own inhaler with them to take part.  This has been medically prescribed for a reason.  This must be carried on them at all times so they can self-administer should they need to.  In the event a player doesn’t have the correct medication to be able to treat their own medical condition with them, entry will be refused and no refunds will be given.

 

30. Call Recordings

All of our calls are recorded for training purposes.  Should you wish to obtain a copy of your specific call, please make your request in writing.  If available, you will need to pay the amount of £25 to cover administrative costs.

 

31. Our right to refuse bookings

We reserve the right to refuse bookings for our site or any of our activities and to reserve the right to refuse entry to our site whether that is as a guest, a player, or an invited guest.

 

32. Adventure Camps

On our 4-day adventure camps, we do not refund for non-attendance on any days your child fails to attend for any reason including illness and injury, under any circumstances.  We also cannot accommodate multiple late arrivals, multiple late drop-offs and mid-day pick ups.  This limits the activities we can do, impacts the sessions and supervision levels, and disrupts the day.  All players need to be present for the morning briefing.  We also do not refund for any part attendance in our camp.

It’s important to note that we don’t transfer any unused days to the next camp, and we also don’t offer refunds for non-attendance or unused days. So if your child is unable to attend any of the four days you have booked, they won’t be able to make up those days at a later camp, nor will you receive a refund for the missed days.

33. Other Conditions

Except as otherwise provided in these Booking terms and conditions, LASERGAMING AND HIGH ROPES LTD shall not be responsible for the loss, or damage of or to any property or to any person arising from the booking of or participation in the activities we provide or force majeure.

Parking facilities are available at the site and any vehicles and their contents are left at the owners risk.

On our full day Adventure days for children aged 8yrs to 15 yrs – please note, although it may seem obvious – This adventure day is for children only and parents are not required as above, and is used by many as a child care facility dropping off at 09.00am and picking up at 5.30pm, unless an alternative time is given.  In line with our company and child protection policies, we can not accommodate parents that wish to wait for their child on site all day as this activity is for children only.  Abingdon town centre is 2 miles away and there are many local pubs in the surrounding area should you wish to stay local.

In the event a refund is given in exceptional circumstances in accordance with clause 9 or 10, the refund will be minus any fees and charges we have incurred to process the transaction and process the refund, the card processing fee and any other charges from stripe such as refund fee.  This will be deducted from the amount paid.  All refunds are made via BACS (Bank transfer) only.

Nothing above shall confer on any third party any benefit or the right to enforce any of these booking terms and conditions.
